The
reason behind the Vape apocalypse and the changes happing at Vapor E-Cigarette
LLC.

It’s
always an advantage to know the vaping laws governing the marketing, sales, and
use of vape products, especially if you’re a company in the e-cigarette
industry or a vapor. In the U.S, the sales and use of vape pens, liquid
nicotine, e-cigarettes, e-liquids, or bulk import of such products aren’t
without a list of requirements and regulatory guidelines.

Companies
need to ensure compliance for their company and employees. This calls for an
in-depth understanding of the rules and regulations surrounding customer age
verifications, product placements and displays, sampling, internet and mail orders,
restricted store sections, and many more.

Like
most laws in the U.S, there are state and federal regulations for nicotine
devices. Certain states in the U.S consider vaping companies to be
manufacturers and retailers. What this implies is that they must deal with
additional rules and laws. Ensuring that they are compliant will save them a
lot of delays, fees, and fines.

Plus,
the FDA is pointing to a full-out ban on synthetic nicotine, also known as TFN
or Non-tobacco derived nicotine. Most (approx. 90%) of premium juices on the
shelf today and including 90% of popular disposables containing this type of
nicotine, that is NOT approved by the FDA, will be required to be removed from
shelves by July or August of 2022.

This
article covers five essential laws you should understand as a vape company and a vapor
in the U.S. But before diving into it, let’s look at a general overview of vape
regulations.

A Quick Overview

In the
latter part of December 2020, a budget package saw the light of day after its
passing by Congress.

The
package included the likes of the coronavirus relief bill, but what would
interest most vape companies was a 5000-page document also located inside the
package.

This
document was the law called the Preventing
Online Sales of E-Cigarettes to Children Act.

It regulated
several vape products, like the dual
battery vape mods and the more sophisticated vape setups like the Tesla Punk Vape
MOD. But this was just a piece of the iceberg, and laws such as these can
easily go unnoticed if you’re not paying attention. So, let’s take a closer
look at five of them.

1. Preventing Online Sales of E-Cigarettes to
Children Act

President
Trump signed this Act into law in 2020. In the vaping industry, this act is
commonly called the “vape mail ban.”

However,
vape companies will feel the effects of the Preventing Online Sales of
E-Cigarettes to Children Act reaching past the postal delivery. Despite its
popularity since December 2020, this law isn’t new.

It had
previously passed the House back in 2019 and, in July 2020, made its way to the
Senate in somewhat different forms. However, the Senate received a
call-to-action from CASAA concerning the bill before its passing in the summer.

Overall,
few vape businesses and vapers are alarmed by the possible impacts of its
passage, not knowing its full impacts.

These
impacts are just NOW being felt in the closure of some online vape businesses,
no shipping options, or the very long wait for vape items to be shipped. This
includes many on social media asking about “What Happen” to so and so and where
I would get my vape supplies. This law has caused many to close or go B2B
(Business to Business only) and limited consumer choice by over 60%.

2. Preventing All Cigarette Trafficking (PACT)

All
vendors of vapor products and businesses that deal in devices that deliver
flavor, the nicotine from an aerosolized solution, or other substances that
enable users to inhale will have to comply with Prevent
All Cigarette Trafficking (PACT) from late March
2021. This law also goes by the name Jenkins Act.

It
regulates regular vapor products that deliver nicotine and non-nicotine vapor
products, which the government might regard as containing hemp oil. You read
that correctly, even zero-Nic juice is included!

Failure
to abide by the rules and regulations stipulated by the Jenkins/PACT Act
exposes vape companies to the possibility of heavy fines in the sums of $5,000
to $10,000 for each violation.

Because
of this FedEx, UPS, DHL, and USPS have either eliminated or severely limited
shipping with double to triple the shipping costs. The vape community has tried
to address this with shipping options like the company ‘X’, but they are all
Freight shippers and can take months to deliver. The exceptions are those that
don’t tell the shipper service it is a vape product, then it gets through, but
we don’t think that will last much longer because the first time there is a
nicotine leak in 1 shipment, then there will be inspections done on all
packages from any suspected source. This will end all side steps.

Then
under President Biden in 2022, a tacked-on bill to add synthetic nicotine to
FDA regulation was added to the spending bill that passed. So far, the FDA has
said they will totally ban all non-tobacco-derived nicotine. This ruling is
coming in the next few months.

3. FDA Regulation of ENDS

Electronic
nicotine delivery systems, otherwise termed ENDS, are devices such as vape
pens, electronic cigarettes, vaporizers, and e-pipes, among many others. All
these devices are non-combustible tobacco products.

The FDA
in 2016 concluded a ruling that extended CTP’s regulatory
domain to cover tobacco products, including ENDS that fall under
the category of tobacco products.

Hence,
the FDA controls the import, advertising, sale, packaging, distribution,
labeling, and manufacture of all such products. Its regulations also cover the
parts and components of ENDS. However, it excludes all accessories. Some
examples of such components include:

Battery
(this is why there are now labels on most vape batteries that the battery
is not for vaping, this is to keep the FDA paws off of batteries)

Atomizer

Cartomizer

Cartridge

Clearomizer

Tank
     System

Drip
     Tip

Programmable
software (yes even software is considered a Tobacco product for the FDA if
it is for an ENDS product, you know, the kind to update your mod device)

4. FDA Tobacco Regulations

Businesses
that produce, modify, fabricate, mix, fix, assemble,
repack, label, import, or relabel ENDS must also abide by the requirements
for manufacturers, in addition to the first three laws.

If your
company falls into this category, the FDA considers you a tobacco product
“manufacture.” Even companies that import finished tobacco products must comply
just like tobacco products distributors or manufacturers. They must file a
PTMA. As of writing this, over 98% of vaping has received MDOs. This doesn’t
mean it is off the shelf. Many companies are going ahead against the Market
Denial Order and still make and sell. They are of the mind they won’t stop till
the FDA forces them. Since the FDA is a government agency, it means it moves slowly,
but don’t be fooled. The FDA with the force of the ATF (Alcohol, TOBACCO,
& Firearms) will act to enforce these regulations.

Therefore,
vape companies must register their company and submit a list of products,
advertisements, and labeling. Per the regulations, other details needed to be
submitted include an ingredient listing and data. We at Vapor E-Cigarette have
filed this list for a retailer.

5. Protecting American Lungs and Reversing the Youth
Tobacco Epidemic Act

In
February 2020, the U.S House of Representatives approved a bill to tackle the
youth tobacco crisis. The name of this bill was
the Protecting American Lungs and Reversing the Youth Tobacco Epidemic Act of
2020.

It bans
most flavored tobacco and vaping products such as mint and menthol flavor.
Plus, it imposes taxes on nicotine e-cigarettes and affects vape companies. However, it has not passed
the Senate…yet. However, the FDA has not approved a single flavored product
except for Tobacco, and they are about to ban Menthol. They are already moving
to ban flavored cigars, loose tobacco, and menthol cigarettes.

Conclusion

One
vital fact to always keep in mind, the law and regulations are always subject
to modification via the passing of new legislation, federal decisions, ballot
initiatives, high court rulings, or other approved methods. Therefore, it’s
always necessary to follow the latest developments and know current
information.

Often,
understanding the complex rules and how they affect the vape business can be
challenging. Therefore, companies may need an attorney in addition to their
legal research to clear all their doubts.

DON’T PANIC, We at Vapor E-Cigarette
LLC do have a lawyer to help guide the company through this regulatory maze.
Because of these new laws and rules, Vapor E-Cigarette LLC must change a few
things we do to stay compliant. Because
of the FDA requirements and being forced to have a lawyer, it may be necessary
to raise prices, but we are working hard to keep current pricing for you. We
have been working hard the last few months to plan. We are now initiating that
plan to be viable and to be here for years to come for our customers, our
future customers, and all vapors. Vapor E-Cigarette LLC does not see these
changes in a negative light, but as more of an opportunity. This is the reason
behind having our event & sale. We understand that these changes may rattle
some but be assured that we will do everything we can to make these changes
barely impact your vaping experience or supplies. Rest assured, that our plan
is working to survive these regulatory requirements and that we can and will be
here for YOU. Please help by telling your friends and family about us and our
products.

Vapors
need to keep informed on what their government is doing. Stay engaged, and
contact your representatives on the Local, State, and Federal levels. Remember
to let them know your story on how vaping has helped you, you vape, AND YOU
VOTE! Educating our leaders always has influenced the way they regulate.
Therefore, educate, share your story, and send our leaders the REAL science on
Vaping, Kratom, and Hemp Products. Without ALL of us, then NONE of us will have
the choice of these life-changing products.

Please
like, share, and comment #BurnedbytheFDA for a chance to win the 2nd of 3 $150
gift certificates on Facebook. You will have 1 week to fulfill the
requirements. Any like, share, and comment after the week will be disqualified.
This is the 2nd of 3 posts that has a chance to win a gift certificate. A
random drawing will be held for those that follow the instructions to like,
share, & comment on each post where each post is a chance to win 1 gift
certificate. The gift certificate will be good for any items in store and in
stock with no special orders and are good for 90 days.

And as
always thank you for your support.

The
Vapocalyse is upon us.

Over
the past couple of Years, the FDA has issued marketing denial orders (MDO's) to
nearly every company that submitted a PMTA, to keep their products on the
market. The few companies that have escaped will almost surely receive their
death warrants soon. Now that the FDA has the right to regulate synthetic
nicotine, they have signaled that they will not approve any product with
tobacco-free derived nicotine.

The MDOs amount to a de facto flavor ban. The FDA claims the
rejections are because the applications lacked "sufficient product-specific
scientific evidence to demonstrate enough of a benefit to adult smokers that
would overcome the risk posed to youth."

However,
this was not a standard that was issued prior to the PMTA submission deadline
or ever once uttered since. The FDA is essentially applying a retroactive
requirement and is using the fact that no companies fulfilled this tacked-on
standard to justify decimating an entire industry.

Moreover,
the FDA has spent the past 5 years telling vape companies that we cannot
advertise or sell our products as smoking cessation devices. Now all of a sudden,
they are turning around and demanding that we prove that they are?

All flavored vape products are being rapidly forced off the market
except for tobacco flavors, as the FDA rubber stamps rejection letters to every
vape company in the United States with nearly identical form letters.

The
MDOs (Market Denial Orders) are not being reserved for small companies or PMTA
applications of low quality. Several very large vape companies that spent
between 10 and 20 million dollars on their PMTA applications have also received
the exact same MDO letters for all their flavored products. We expect the MDO will
force most to all products off the market apart from Tobacco flavored e-juice
and the few FDA-favored hardware items.

The
PMTA process is very costly and many small businesses like us at Vapor
E-cigarette, could not afford this process. We have tried everything we can to
stay compliant. We will continue to sell ALL our products, but we will have to
change a few things to stay open under the new FDA’s draconian overreach of the
vape market. Based on what we have seen, only Tobacco flavors are being
approved by the FDA with the all-out ban on all other flavors. This includes
cities and states passing their own flavor bans. This has forced many into the
DIY world. FDA has already, through a lawsuit admitted it could not regulate
the DIY Vaping Community, which we at Vapor E-cigarette will have to adapt. We
already offered for many years DIY supplies, so we will have to make that our
focal point going forward. We are being forced to stop offering an in-house
completed tobacco product to our customers.

Like most vape companies, we will almost certainly be forced to adapt.
Moreover, given the outrageous actions on the part of the FDA, We at Vapor
E-Cigarette LLC believe it is worth continuing to adapt and overcome.

The FDA has shown a
blatant disregard for the rights of small business owners. They have not only
kept us in regulatory limbo for over a few years, they actively encouraged us
to continue to invest in our DIY in anticipation of receiving deficiency
letters and an opportunity to keep doing business.

In the end, none of it
mattered. We have fought it with documentation, studies, test results, working
with national groups, and much more to get the FDA to recognize the importance
of vaping. The FDA never even looked at any of it and dismissed most of it
except a few small notes buried on their website. We received the same form
letter they delivered to every other vape company in the United States.

Meanwhile, the FDA has
punted on making a decision as to whether it will continue to allow Juul and
other Big Tobacco vape products to remain on the market. The FDA as of this
writing has only approved 3 vape products.

The FDA's recent actions
have shown us that the PMTA process was a sham. The FDA never intended to give
a fair review to any in the vape community. They are destroying hundreds of
small businesses and handing the market to Big Tobacco.

It is Vapor E-Cigarette
LLC intention to let our customers know the changes we will have to make to
keep offering vape products to you, our customers for years to come and to keep
FDA out.

However,
we have already told you through our blog, ‘Don’t Panic’. If you are not

that are coming. Please be aware that our newsletter and blog are the best ways
to stay informed because there are also limitations set on vaping on social
media outlets we must tread lightly on those platforms.

We
are not going to approach these changes as a negative and you shouldn’t either
but as an opportunity to show the powers that be, that we as vapors are
resilient. That no government agency is going to stop us. We will do whatever
it takes to stay away from smoking and help others discover the wonder of
Vaping, Kratom, and Hemp Products.

To
prove these changes are not negative, We at Vapor E-cigarette, are doing a
giveaway of 3 gift certificates to help get the word out about the changes.
Plus, we will be having a ‘BURNED by the FDA’ event and sale to celebrate the
changes we will be doing to stay in business to keep you supplied with the vape
products, Kratom, and Hemp items. This includes introducing our new DYI Juice
kit called ‘Juice Barrel’. We will also be opening our website for ordering
with in-store pickup only. You can check out our new re-vaped website now, just
can’t order yet because the changes are still happing. We will also be adding
QR codes to our products, that way if you, friends, or family wonder about a
product you got from us, you can scan the QR code, and it will guide you to the
product section on our website.

To
qualify for the first of three gift certificates worth $150, (1) you must like
the Facebook post, (2) share it on your page, and (3) comment. ‘Liked, Shared,

The winner will have to show proof of following all 3 before the gift
certificate will be awarded. They will be awarded on the day of the event &
sale. The Gift Certificates will be good for any item in-store and in stock,

the 3 posts will run for 1 week. Any like, share, or comment after 1 week will
not qualify for the random pick for the gift certificates.

Get

The End of the 20700 Battery

If you’re
reading this, you might already know that the 20700 battery has come to an end
and major manufactures have already stopped making them.

Vape
batteries are one of the most common components in vaping devices. The 20700
battery that has been rapidly being replaced with the 21700 as of late, was not
always that popular. Yet there are still many vaping mods that use them and
some that can only fit the 20700.

Why it’s
happening

The 20700 battery has been on the market since around 2017
and is a logical successor to the 18650. These new batteries were larger,
better, weighed less than the 26650, and more long-lasting than their
predecessors. In addition, they were being used in power tools, flashlights,
and other battery-operated devices in order to prolong their usability before
needing to recharge. In the world of vaping, it seemed like a godsend. After
all, you don't have to worry about changing the batteries or recharging as
often with this kind of mod. But, of course, there are drawbacks. Lots of
manufacturers were yet to produce high-capacity mods that supported the 20700.
But when they did finally come out, the vaping community was torn. On one side
there were those who liked the idea of longer lasting mods while the other was
upset that they would have to pay more to replace their batteries and in some
cases battery chargers to fit the bigger battery (unless you were using 26650).
Even though demand for the 20700 wasn't as high, it still was a good improvement

As soon as people learned that companies started
manufacturing 18650, 20700, and 21700 battery compatible mods, the 20700 was
considered a stopgap. So many people did not want to dispose of their original
18650. However, once the 18650 died, most consumers moved over to the 21700
because battery makers looked at the 20700 as a failed idea. The power and
portability benefits were too good to be overlooked and many other tool
companies, such as DeWalt, abandoned the 20700 for the 21700. This was the same
for mods. Vapors just skipped over the 20700 for the 21700. So, the decline of
the 20700 was inevitable.

What you can do now

If you're
one of the few people who like the 20700 and invested in mod equipment that
fits it, now is your time. You can buy a sleeve that would make your 18650's
fit in it instead. Vapor E-cigarette still has dependable 20700
batteries in stock. All you must do is come in and pick them up. These units
will now be an item for collectors because of the 20700 ending. So do not fear
that the 20700 battery is going extinct, but instead take pride in owning one
and know that it is one of a kind that will never be seen again. That makes it
unique and valuable in the vaping universe. The trend now is either to get mods
that use batteries other than the ones that came with your device, or just to
get 18650/21700 batteries which are compatible with more mods. The only
drawback is that this opens the door to the cost savings of battery choices.
What this means is that there is no need to have many different batteries to
provide power to your vaping habit. But what you need to do is be sure that you
buy good batteries from reputable retailers and sites. Plus, they should give you
advice about battery safety.

It's not
just about turning off your e-cigarette after every use, but keeping you and
your mod safe to use, keep battery safety at the forefront of your mind and
you'll be safe. It would be unfortunate if we cannot use these any longer
because a story of battery accidents shuts us down.

will now be an item for collectors because of the 20700 ending.

If you are a vapor, doesn’t matter
if you vape nicotine, CBD, THC, or just flavor. You vape to escape the smoke.
Just like most of us vapors, we escaped cigarettes. Vapes became the lifeboat
when nothing else worked. Vapes can even help someone not eat sweets if they
just vape it instead. Vapes changed the world for the public while it bit into
the money for Big Tobacco, Big Pharma, and Big Government.

Vapes that bit into the 3 BIGS
money has caused a huge ripple in the world of vape. Vapes were invented and
made for individuals when the 3 BIGS and all the non-for-profits only blew more
smoke by just talking but never coming up with a real solution vapes filled.
This scared them all. We all know what happens when you scare the 3 BIGS, they
start to regulate it out of existence. That is exactly what is happing.

So, let’s play the what if…then
game. What if vapes disappeared? Well for me the world would become a black-market
quickly because I am not going back to smoking, just like the rest of you feel.
But we hop aboard the time machine and go to a future where vapes are gone,
disappeared, regulated out of existence. Then what? We see some back to smoking
cigarettes or other legal tobacco products and the deaths related to smoking
goes back up. The 3 BIGS are back making their money while people die. Same
song 2nd verse could get better but it's going to get worse.

We are now 20 years into the
future 2042. As a vapor, I am going to find the black-market. I would make a
‘speak easy’ for vaping. Some say vaping is too big to be taken down. They
thought that about alcohol too. But did you know the first Black Woman
Millionaire made her money by running black-market alcohol? Well, us vapors can
run vapes. We can learn from the past and make safe products. We can 3D print
our own mods, buy electronic components that are available, even write the
software. In 2042, technology will be bigger (as shown from the last 20 years).
We can keep vapes alive. While we do this, we fight the 3 BIGS. We change minds
and educate about the real world of vapes. It may take awhile but we can bring
it back for the betterment of all smokers.

Now, we hop back to our own time,
2022. What are we doing to keep vapes from being regulated out of existence?
Are you fighting it? Are you stock piling? Are you calling your
representatives? Instead of waiting for 2042, let’s get motivated to keep vapes
alive and well. What can you do?

The first thing is to talk to your
friends and family about what vapes have done for you. Second, go make an
appointment with your representatives and talk to them and give them real
stories and science along with the FDA & ATF. Third, fight the
misinformation spread by organizations like ‘Truth”. Don’t just call names or
use derogatory language, just explain it with a cool and calm voice. Have
conviction in your conversations. Call out manufactures that use pictures or
names that appeal to kids. Stop that clerk or person outside selling to kids.
If all of us stand up, the 3 BIGS can’t do anything. They can only take away
vapes if we let them. If they want to use kids to outlaw vapes, then let’s take
that option away. Whenever possible, talk kids out of vaping. Don’t let
manufactures use cutesy names or packaging, tell them to change it. Ask your
local retailer/convenance store about their policy on selling to kids and check
on them whenever you go in for that drink or coffee. Talk to the manager or
head office to make sure the vapes they choose to sell don’t appeal to kids. Be
polite but determined in your message that vaping is a life saver for adults.

Now I know politics is not for
many, but we must dip our toes in to get our message across. I don’t care if
there is a ‘R’, ‘D’, or a ‘I’ after their or your politics, we are all vapors.
Not everyone is going to see eye to eye, but we all can agree vapes need to be
here now and 20 years from now. Our vape world won’t end if we vapors’ work for
it. The 3 BIGS are using their money and weight to shove us around. Are you
going to stand for it? If vapes disappeared, how would you get it back for you
and all vapors?

Why will the vape world not
disappear? Because of all vapors will stand up for their life changing/saving
products. Our rebel community will take on any challenger threating our devices.
We are not going away. All of us will save it together.

However, above it all, be a
representative for vaping. Be seen, have conversations, be a witness and above
all else, don’t go back to smoking.

Be well and take care.

DON’T PANIC -By Cloudy Shaman-

Yes, this is from ‘The Hitchhiker’s Guide to the Galaxy’.
You know that old movie where only 1 human is rescued from the destruction of
the earth.

Well, this may not be the destruction of the earth but
about the destruction that the FDA is doing to the vaping universe.

If you don’t already know, the Federal Government gave FDA
the power to regulate vaping, all of vaping. This includes but not limited to
zero nicotine juice, mods, pods, coils, batteries, even the software. This
herald the end of vaping as we knew it. However, when a laboratory was able to
make nicotine synthetically, that opened the door to keep most vaping products
and in-house juice being made and sold. This left the FDA in the dust. Or the
vape world thought it would work because the law required a tobacco product to
be derived from tobacco. Synthetic nicotine, since it was not from tobacco,
allowed manufactures of vape products to continue. All a vape company’s products
that had once been denied by FDA, could now continue without being pulled from
the market.

BUT (knew that was coming), the
last budget bill passed into law (March 2022) had a vape rider introduced by
the Representative from Illinois and signed by the President. This rider added
synthetic nicotine to the FDA regulations. This requires all vape final and
completed products to undergo the PMTA process. This process is time intensive,
extremely costly, and no guarantee of approval. This has caused many vape
manufactures, suppliers, and retailers to close. FDA uses the ATF to enforce
this policy. This isn’t a joke. The FDA has already caused the closing of many
operating in the vape universe. The ATF has already rated many stores and
manufactures because of this PMTA that came about by the Deeming Rule. If you
want more details, we added links to the bottom.

Since synthetic nicotine is under FDA now, several vape
related products and businesses who used synthetic nicotine to continue to
operate, now must go through the PMTA process or shut down (usually forced to
shut down). The FDA has opened a very short window for those who changed their
products to synthetic nicotine to file and begin the PMTA process. This starts
now (4-1-2022). Those vendors have till 4-14-2022 to get their ducks in a row (required
documents gathering). Then from 4-14-2022 to 5-14-2022, those companies must
file their documents for PMTA. On 7-13-2022, if the vape products have not been
filed or approved, then they become illegal and must be removed from the
market. This will be enforced by the ATF.

Also, it has been already signaled by the FDA, if a vape
company’s vape products had already been denied before the switch to synthetic
nicotine and that was the only change, then the chances of those items being
denied again are almost at 100%.

What does this mean to YOU? This
means that the vape products you rely on to keep you from smoking are highly
likely to be removed from the market. The FDA had already denied millions of
PMTA’s and many who DIY, have been slowly discovering this fact, because some
of the big players in the vape market have already closed. Since they could not
afford the FDA PMTA process or were denied and forced to close. There are
several lawsuits in the works. However, there is as of right now hope but no relief yet.

DON’T PANIC– Just

and vape distributors & manufactures. We are going to do whatever needs
